“Don’t Ask, Don’t Tell” Challenge Fails

The U.S. District Court forthe District of Massachusetts has granted the government’s motion to dismiss in Cook v. Rumsfeld, a constitutional challenge to the military’s “Don’t Ask, Don’t Tell†ban on lesbian, gay and bisexual service members.

Update: Servicemembers Legal Defense Network (SLDN) announced on May 15, 2006, that it intends to appeal a court decision dismissing its constitutional challenge to the military’s “Don’t Ask, Don’t Tell†ban on lesbian, gay and bisexual personnel.

Legal Update – April 2006
Posted on April 20th, 2006 No commentsWell things have been a little slow on this. The latest from the Collin County Justice Court is that the case will still be assigned a date in May or June. Given the timing of the CCGLA annual meeting (May 23), I am hopeful that the date is in May before this meeting.

Legal Update
Posted on March 14th, 2006 No commentsStill no date for the legal action against CCGLA. In discussing this with the County Court, they advised that it will most likely be scheduled after May, when the court starts to meet more regularly (the Justice Court deals with a lot of truancy issues, and it appears this is best handled when kids are not in school). I am proceeding as if the case will be heard, as I’ve not received any indication that members of the CCGLA Board want to settle this matter.
I am continuing to build my case and have built quite a large amount of information that will reinforce the claims that I’ve made in my complaint. I am continuing to focus on the fact that the CCGLA Board acted inappropriately, and outside the rules of the organization, however given recent comments by a CCGLA board member, I now plan to submit proof that the lack of professionalism of some members was ingrained by previous members of the board. Being an information junkie has its benefits, especially when it comes to keeping emails and phone logs.

CCGLA Responds to Complaint
Posted on January 18th, 2006 No commentsToday, I collected the response to my complaint filed by CCGLA.
In the document, filed with Collin County Justice Court on December 12, 2005, CCGLA denies all the claims in my complaint, and provides reasons to justify this statement.
In the response, CCGLA makes reference to a withdrawal of “‘written consent’ at a November 20, 2005 meeting which had no impact on the outcome of the Collin Equality Foundation special meeting.” The written consent that is being referred to, is my notice not to waive notice for the purpose of the meeting being called, and the outcome was never meant to impact the outcome of the CEF meeting, as it was relating to my position as a director on CCGLA, and my attendance at that meeting.
It seems that the matter will now be settled before the Justice Court as late as May.
